OK folks...tried to do the best I could - couldn't find a transcript so I decided to make one...

Interview was conducted by two people from the local CBS affiliate in San Diego. This is their site: http://cbs8.com/

Reporter 1: Mr. Bloom, have you ever seen anything like this before?

Bloom: Well, Stan, one thing should be really clear. The first thing that should be said on this matter is that no one should say that this system worked. Justice was done in this case but it wasn't because of the effort of the prosecution. It was despite the effort of the prosecution. So, Yes, I've seen this happen before. In fact, I've seen it happen in this county before, where an overzealous prosecution goes forward and only gets dismissed by a fluke. It happened some 10 years ago involving an officer who was killed where only because of the fact that the district attorney's investigator, or I mean uh, witness was taken out by the district eattorney's investigator and had sex in the district attorney's office and there happened to be a photograph of it. All too sadly, Stan, that there has been a pattern of this in this county. This is evidence that was absolutely available to the prosecution, exonerating evidence, proving that Cyndi Sommer is not guilty, proving that Todd Sommer did not die from arsenic, and that the original evaluation which was that he died from natural causes was exactly true. The prosecution didn't do the effort to look for it and that's a mistake.

Reporter 2: And now as you point out, it's a complete 180 because the original case hinged on the fact that they argued that she poisoned him with arsenic and in fact there was none found in his system. Now this seems almost ludicrous.

Bloom: It would be ludicrous, it would be almost whimsical, Barbara, if it wasn't for the fact that Cyndi Sommers, a young widow, whose husband died, was taken out, away from her four children, and stuck in a cell somewhere in this county right now, as a result of the prosecution's efforts right now. She's been in there 2 years and 4 months an innocent young woman.

Reporter 1: Yeah, that is very sad. That is a tragedy being away from her children, uh, especially during the time of grief. Now we know that she, it was not murder. Um, what is the next step now for you? What is the next step now for Cynthia Sommer?

Bloom: Why are we doing this at 5:00 at night? At 5:50? Because the prosecution made an effort to hide this. They called me at 4:15 to say they were going to rush to court to go forward with this and then presented a document. A document which they say, uh...presents them in the positive light that they are doing their job. And in fact, they set it at this late hour because there wouldn't be publicity about it and this document is full of inaccuracies and lies. They attempted to try and cover themselves so in fact they can show that it wasn't really their fault, that as soon as they found out about the innocence of Cyndi, they went ahead and dismissed it. That's not the case. They found out about it because we demanded they get the evidence, then they find that this evidence is innocent 4 1/2 years after they put a witch hunt on Cynthia Sommers, then they go ahead and dismiss the case.

Reporter 2: Allen, now comes the question of justice for Cynthia Sommer. What comes next?

Bloom: Well, she's gonna get outta jail tonight. I don't even know if Cyndi knows about this. She might, right now, be listening to my words and for the very first time be hearing the fact that she is getting out of jail. I'm not sure, I wasn't able to reach her. I reached her cousin, Todd Tise (sp?) and his wife Carol, who have been the best of supporters throughout this entire ordeal and all the other people that have supported her. But we haven't been able to get, to talk to Cyndi yet. I'll meet her at the jail today when she is ready to because Judge Einhorn (sp?) ordered her release this evening.

Saber, THANK YOU! It was really good to be able to read what you were able to present, and I greatly appreciate your help on this. I enjoyed reading this interview, and I'm sure anyone else will too. I'm wondering if anyone else besides me is seeing some shades of what I call a "Nifong Prosecution" in this case? Because these samples being "lost" for such a long time is starting to sound VERY suspicious to me!

Mr. Bloom asked for those samples several months ago. IIRC, they were told then that the samples were lost or had been destroyed.
Funny how they just showed up and not only that, Mr. Bloom knew nothing about it until just this week. Regardless of the outcome, he should have been notified when they were found. How's that for a sleazy prosecutor’s office.

BTW, as others have asked, anyone seen or heard ANYTHING from Laura Gunn. BD didn't even mention her in the news conference.

"Funny" indeed. This is beginning to sound almost exactly like what went on 3,000 miles away, in NC, where Mike Nifong was purposely hiding the exculpatory evidence from the defense!

If LG was the prosecutor deliberately hiding the tissue samples and claiming they were "lost" or destroyed, she should get the same punishment as Nifong; investigation, followed by disbarment and possibly criminal contempt charges as well.

I'm so darn SICK of prosecutors who bend, twist and even BREAK the law to satisfy their own personal career ambitions! As far as I'm concerned, there is a need to have criminal statutes against Prosecutorial Misconduct put in place, and Police/Judicial misconduct as well. I'm not suggesting anything as harsh as 20 years, but I'm tempted, given what some of these rogue prosecutors recommended for the ones they were attempting to railroad.

However, I'll be more reasonable, and suggest that a sentence for Criminal Prosecutorial Misconduct, if that is ever passed, should be no less than 3 months and no more than 1 year. And the offender should serve that sentence in the local city/county jail. Maybe THEN prosecutors who might otherwise be tempted to play fast and loose with the rules of law and due process will stop and think "maybe that's NOT such a good thing for me to do."

No problemo....and yes, I completely believe that Cyndi got "Nifonged" - and I too find the exculpatory samples being "lost" very suspicious.

Did anyone catch Cyndi on Jamie Floyd today? Excellent interview as well. Considering what she has been through, Cyndi was more than gracious.
