Trist hello my name is Joann my son Donald Bradish is 8 years into a life sentence . Donald Bradish went to a motel one day to get his girlfriend out of a dangerous situation. The manager at the motel hired teens to steal things for him, and Donald used to work for him. However, after being put on parole for stealing things for this man he refused to allow himself to be sucked into that world again, and he did not want his girlfriend to go through the same things he did.

He arrived at the motel and began to talk to his girlfriend in the motel’s parking lot. There were a lot of kids in and around the motel who also worked for the manager. All of a sudden gunshots were heard from inside the motel. Donald started running. He was on parole and did not want to get into any more trouble. He got a ride to his mother’s house, which was outside of county limits. This was against his parole rules, but he did not know where else to go. He was sick with anxiety.

Eventually his parole officer came to take him to jail for breaking parole. He served an entire 15 months. Right before he was to be released the cops questioned him about the shooting at the motel. Donald did not say anything. The day he finally was allowed to go home, the policemen arrested him and charged him for the crime of murdering the motel manager. He and another boy were charged. A drug dealer gave the D.A. Donald’s name in order to get out of being charged for bomb manufacturing.

During the trial numerous problems arose. At first they were told the trial wouldn’t be held due to “possible bias.” When the family of the manager came forth with the murder weapon, the courts refused their help. They disclaimed their statements because they were “trying to mislead the investigators.” One person on the witness stand, who was in the room at the time the manager was shot, was asked to tell the court if the shooters were either of the two boys being charged. She said she “didn’t know them,” and that the shooters were two light-skinned African Americans. Probably the same two boys who had been threatening the manager of the hotel earlier the day of the shooting and scared away the maid on duty.

Then things became outright unbelievable. One of the jurors was being harassed so much that she became very upset in court during the trial and said she “would rather go to jail than finish out as a juror.” Soon after two more jurors refused to finish for unknown reasons. Here’s where it becomes downright wrong. One of the replacement jurors was the aunt of the victim. When she was selected as juror she sated that she did not know the victim, but the truth was later brought to light. The judge refused to remove the aunt off the jury. They said, “it will be OK.”

Over fourteen of Donald’s rights, according to the local laws, were broken and tossed aside. He did not receive a fair trial. He was clearly guilty until proven innocent, and no one made the attempt to find him innocent. His sentence is to serve 25 years or for the rest of his life.

Please sign the petition to free Donald. By signing the petition you are saying that Donald’s trial was unfair and the ruling should be thrown out. He’s already served 8 years, and he shouldn’t have to stay there one day longer. I have hired a privet investigator and project innocent has just started working with me it has been a long and hard road but we are still fighting to bring him home please if you can help let me no Thank you Joann

Welcome to the forum, Joann! I can't imagine what life has been like for you for the last 8 years.

I know I will have some more questions and comments as I digest this post but the first thing to jump out at me is the fact that they let the victim's aunt serve on the jury??? Wow....just wow....

Regarding the victims family and them bringing the murder weapon to law enforcement - was it the family's position that law enforcement had arrested the wrong person?

What state did this occur in?

Hi Joann, and welcome to WhatSayYou! I cannot imagine what it has been like for you and your son for the last eight years. It sounds to me like another case of a defendant being in the wrong place at the wrong time.

I can't believe a judge would be so misguided as to allow a family member of the VICTIM to serve on the jury when her relationship to the victim was made known!

In addition to that, this aunt LIED about not knowing the victim when she was questioned. Isn't that JUROR MISCONDUCT? Lying in court, isn't that PERJURY? Seems to me there are a couple of serious issues here, which should get this man a new trial!

hello thank you for posting back to me.The family member that went and got the gun was my ex brother inlaw when he heard Donald had been charged with the crime he hit the streets and found the gun we then went to the cops and tried to turn it in but the DA said I was trying to turn the trial in another way and would not take the gun,in was never tested but I feel it was the gun used,people tried to come to court and tell what happened but they were never a loud to speak on Donald behalf.And yes the aunt did lie when we were picking the jury she said she did not no anyone we also still had one juror who could have been picked but Donalds PD just sat there and did nothing,the DA was running for reelection trying to set a record for being the one DA who has been reelected more than any other DA in CA he wants to run for state attorney so many thing happened in my son trial it makes me sick every time I think about it.Thank you for your help JoAnn. Joann, would it be possible for you to tell us what city your son's trial took place in? California is a huge state, so knowing the city would be helpful. Was it anywhere in Kern County, by any chance? If it was, I think I know who the DA in question is, assuming he's still in office.

Good morning hope all is well with you all. Donald was tried in Oroville CA its up north about 1 hour from SAC the DA name is Mike Ramsey he was arrested in Chico CA thats where the motel is that the murder took place,thank you Jo Ann.

Hi Joann! I apologize for not responding sooner. I've been out of commission for a few days having had to have an unscheduled surgery. Trist

What is the status of Donald's case as far as the appeals process goes? I assume he has petitioned the court for a new trial. You mentioned that his PD's during the trial did not work for him (not surprising) - has he been able to obtain new attorneys?

Hello sorry to here you had to have surgery hope all is well. Donald was tried first but they said he was the accomplice and at first they gave him 75 years,then they tried the shooter John Morgan and gave him 35 years so the judge said that Donald should have less time so his PD came to me and told me they wanted to give Donald 25L but Donald said no he would lose his right to appeal so they took me in a back room and had me talk to Donald I though the 25l was better but Donald said he would lose his right to appeal and did not want to so we called the PD in the room and he told Donald not to worry and told him to take the deal and he would fix it and get his appeal back,so Donald took the 25L and his PD then put 450 dollars on Donald books and we have never heard from him again he does not take our calls or letters. So we were tricked into the 25L and don't have an appeal.How do we try to get a new trial we were toled he could not get one so don't no how to try and get one. Thank you so much for talking to me I feel very lost trying to finds ways to help my boy.I will be picking the court house on the 14 of Oct have about 80 or more people coming trying to get his case back into the news and hope the 2 jurors who quiet because the DA was harassing them in the lunch room will come forward and talk to me.Joann

Oh man, Joann....he got railroaded big time! So...initially he was tried and convicted, and sentenced to 75 years? Then the shooter was tried and sentenced to less time....so the judge, knowing Donald would probably win a new trial on appeal under these circumstances, started the ball rolling to reduce Donald's sentence. The prosecution offered a deal, the PD pressured and lied to Donald to get him to take it, Donald took it, and the PD took off. So, because it was a deal, Donald lost his right to appeal it. I sure wish I was an attorney - I wonder if he could appeal it on the federal level? I assume, that the PD's lies to Donald were not "on the record" because of privilege. Does Donald have an attorney at the present time? Or just the PD that has 'disappeared'.....I think that should be the first step. Preferably a private attorney who might be willing to take the case pro bono. PD's work for the state - very few of them care about their clients or work for their clients best interest, imo.

I think that the DA harassing jury members (I assume this was during trial) in the lunch room would be grounds to have the case thrown out, IMO. Not to mention a family member of the victim serving on the jury. I think that there are several issues here which could be a basis of having the original conviction tossed. Have you tried contacting an investigative reporter? As you are demonstrating with the scheduled picketing, you realize how important it is for the press to become involved. I would suggest trying to contact someone like Geraldo, Greta Van Susteren, I would also suggest contacting Jamie Floyd. And I would send numerous emails/letters to them until you grab their attention.




PS - Thank you for your concern...yes, I am recovering nicely. I have been sick for a couple of months and finally had to have surgery unexpectedly last week. Just glad it is over!

Good morning Thank you for posting back to me.Donald has no attorney just the PD have been trying to get one but no money I am on ssi and have 2 teens at home still and whats left of my money goes to Donald his food boxes and money for him to survive I am trying to get him a TV now so he has something to do to keep his mind on other things and not lose it.I am so proud of my son he has kept his head up and stays out of trouble,he is my hero and I love him so much . Pro bono lawyers are hard to find I keep looking and pray I find one. I have been calling news papers about picketing The willows news paper is coming there are from my town and trying to get the papers in butte county to come I think they will a group of christens bickers are coming lots of them and that should get the news to come and look and see whats up. I will try and find out how to get a hold of the people you talked about .The jurors who quit is on record but the deal they gave Donald was in a back room everyone in court new we were in room talking but it was not on record . Nu se poate this has all been so crazy but with people like you helping us I no we will find away God bless Joann.

Hey, Saber! I'm sorry you had to go through this; surgery for any reason can be a scary prospect. I hope it was nothing terribly serious and that you will have a full and speedy recovery. Great to see you back! Aplauze

Joann, I completely agree with Saber that this was a total railroad job done by both the DA's office and the PD, who wasn't about to buck the prosecution. As she also said, PDs work for the state, and they don't want to jeopardize their paychecks.

Now, I know there are some dedicated PDs who DO work very hard to zealously defend their clients, I don't mean to paint them all with the same brush. However, the problem is that these PDs seem to be very few and far between these days. Too many of them are NOT like the PD's in the new TNT series "Raising The Bar."

Here's another idea to add to the excellent ones Saber already suggested. Try getting a copy of the book INDEFENSIBLE, by David Feige, and make a note of the publishing company's name and complete mailing address. He used to BE a public defender, and could be of some assistance, although of course there is no guarantee. You DO NOT have to buy the book to get this information, see if you can borrow it from your local public library. Copy down the information on a separate sheet of paper, and then try writing a letter to Mr. David Feige as well. Maybe it won't come to anything, but at this point, it certainly can't hurt to try. And of course, write to the other people she mentioned as well. At this point, the more people who get the full story about this travesty of a "case," the better.

Thank you justice1 I will go to book store sat and see if I can get the book and I Am going to try and contact the people on post.I found out last night my co host of my web site she has been working with me for 2 years passed away and my heart is very sad today and have to write to my group members and let them no Crying or Very sad Thank you for your ideas and tomorrow I will get back up on this horse and ride again Joann.
