I decided that rather than continue on the same path I started, it would be better to get right off it and create a new one, which focused on what is speculation and what is actually proof in this case. The big problem for me is that I have not followed this case as closely as some others, so there are huge gaps in what I actually know. Thanks, Saber, for filling in some of the details I was missing. Zambeste

So if we had a chart with two columns, one column headed SPECULATION and the other headed PROOF, how would it look right now? Going back and taking a hard look at everything that has been published in the various news stories, it looks to me like a whole lot of speculation, but so far no proof of what actually happened.

In reading the latest PEOPLE story, I've seen the copies of the IM's (instant messages) that were said to be on Casey Anthony's computer. They don't tell anything about what actually happened to Caylee, so I believe that can be added to the SPECULATION column.

The accounts from some of Casey's friends about her complaining about having to care for Caylee don't amount to proof either, do they? So again, that's more SPECULATION.

If all the state has at present is speculation but no proof that a murder actually occurred, I don't know how they expect to back up a first degree murder charge.

I will never forget the day, I believe it was on a Sunday, when the first test results came back on the air samples and were 'leaked'....

The first report we heard was that the results proved that Caylee was indeed dead. No doubt about it, Caylee was dead according to the results. About 4 hours later, the lead investigator comes out and says that they are MOST LIKELY looking for a body. Now, I didn't go to college, and I'm certainly no "Columbo"....but if the test results "prove" that Caylee is dead, why would the lead investigator conclude several hours later that they are "most likely" looking for a body?

I would have to say that the test results were not as "conclusive" as they originally thought.

And the rampant speculation that is flying back and forth on forums like TOPIX is unbelievable, to put it mildly. I'm reading those threads, but I am NOT posting on them. I learned my lesson with the RD Smith case. Like many of the IN SESSION boards, anyone who so much as disagrees with or questions the largely pro-prosecution mindset is viciously attacked and vilified just for having a conflicting viewpoint.

It just reminds me why THIS forum is so badly needed, to give people a more balanced view of any criminal case. I find it rather bizarre that so many people seriously believe that we should do away with the Constitutional protections just to make prosecutors' jobs easier when it comes to someone ELSE's case, but would want those protections back in an instant if THEY were ever charged with a crime.
